Case Management Officer
A vacancy exists for the position of Case Management Officer in the Compliance Department of the National Bargaining Council for the Clothing Industry in the KZN Regional Chamber (KZN).
The successful applicant must have a thorough knowledge of the Labour Relations and the Basic Conditions of Employment Acts, including a thorough understanding of Collective Agreements. A good knowledge of CCMA rules and procedures is essential. The incumbent must be fully computer literate in all Windows packages (Word/Excel/Access/PowerPoint). Excellent communication skills, both verbal and written, are a must.
Duties & Responsibilities
ESSENTIAL FUNCTIONS AND RESPONSIBILITIES
- To administer the case management system for Non-Compliance enforcement ULP / Dismissal matters.
- To receive all dispute referral forms including applications for conciliation, arbitration, condonation, and non-compliance (Registered Companies or NOT) Even co-ops must be accepted and set down for hearings.
- To book days for conciliations/arbitrations to take place.
- To make bookings for venues in Isithebe and South Coast, Port Shepstone before, and as commissioner travels to these venues to conduct these hearings.
- To liaise with the different CCMA branches to ensure the Clothing jurisdiction and the transfer of cases to the Council.
- Before accepting applications, check to see if a referral is within the time limits, and whether the Chamber has jurisdiction over the dispute.
- To send out notices to both parties by either e-mail, fax, or registered post (sometimes all) or arrange for Chamber agents to hand deliver documents to the factories.
- To negotiate a date with arbitrators for arbitration hearings.
- To ensure the booking of an interpreter for all arbitration hearings.
- To follow up on arbitration hearings after completion, to update both parties via e-mail where necessary, serving closing arguments on the council and forwarding to the presiding arbitrator. Once an award is ready and completed, the Arbitrator’s award is to be forwarded to the parties.
- To update the case management system timeously.
- To send out notices to parties advising of postponements. To re-schedule diary to cater for those postponements and update the system.
- To apply for CCMA subsidy on a monthly basis.
- To process condonation applications that come into the Council and forward the outcome of all condonation applications to the parties.
- To ensure that every single application referred to the Chamber is recorded on the case management program.
- To ensure that compliance orders are set for arbitration timeously.
- To prepare the necessary documentation for Section 143 applications to the CCMA for ULP matters.
- To administer the case management system for Non-Compliance and ULP / Dismissal matters.
OTHER DUTIES AND RESPONSIBILITIES
- To collect all new exemption applications for the exemption committee and capture onto the Council system. Peruse and ensure that all necessary documentation is attached to the exemption application and liaise with the agent responsible for collecting such documentation before sending it off to the Head office to be tabled for the exemption meeting.
- To compile compulsory quarterly reports for the CCMA for accredited Councils for the region and submit to the Head office.
- To draft compliance orders for inspectors.
- To keep record of compliance orders sent out.
- To scan all documents onto the Case system.
